About Landed Property:

  • What is Landed Property? According to the Israel Land Law (1969) Landed Property is: land, anything built on it or planted in it and anything, permanent or temporary that is affixed to it.
  • What is ownership of land? The right to permanently posses a land and to perform any legal transaction with the property in accordance with the will of the property owner. The possession includes the depth beneath, and the air above the surface.

Landed Property is also named Real Estate as it is distinct from Personal Possessions and from Chattels by it being unmovable.

  • What is a Real Estate transaction? The transfer of ownership or right to the land, usually done through the sale of the Real Estate, additional Real Estate transactions exist.
  • What is Lease in Real Estate? Lease is a right granted for use of the leased land for a limited period of up to five years. When the period is longer than five years it is called a Long-Term Lease and when the lease is over 25 years, it is called a Perpetual Lease (In Hebrew – “a lease for generations”).

It should be emphasized that no Real Estate transaction is valid unless it is done in writing, in accordance with section 8 of the Land Law.

Any Real Estate transaction, be it of land registered in the Land Registry (Tabu), or land registered at the Israel Lands Administration (perpetual lease), requires appropriate reports to the local authorities and the tax authorities. It is impossible to transfer any Real Estate rights without verified tax payments.

The taxes relevant for regular transactions between buyers and sellers of Real Estate are mainly:

  • Improvement levy – When a local municipal committee approves a plan which raises the value of the land and the owner of the land or of the rights to the land stand to gain by it, The owner must pay half of the increase in the land’s value as improvement levy, which is to be paid on the day of realizing the land rights. The rate of the levy is determined by an assessor on behalf of the local authority and it can be appealed within 30 days.
  • Betterment Tax – Tax for gain derived from the sale of the land, as per Israel Land Law (1963).

Purchase tax – Purchaser pays this tax in accordance with the tax brackets that are updated once a year on January 16th. Payment is made ​​within 50 days after signing the purchase agreement.
